The Bundjalung of Byron Bay Aboriginal Corporation (Arakwal) RNTBC hold native title in trust for the native title holders.
On 30 April 2019, Robertson J made a positive native title determination in relation to an area encompassing the north coast of New South Wales of approximately 241.8 square kilometres The area extends south from the Brunswick River and Mullumbimby to Cape Byron and on to Broken Head and Jews Point, inland to Koonyum Range in the northwest and to Coorabell and Bangalow in the south, and extends easterly to 100 metres seaward of the mean low water mark. The determination recognised the negotiations between the parties, which resulted in agreement that certain areas of land were not included in the claim area.
The native title holders have non-exclusive rights and interests attached to the claim area.
