Overview

Kaltupakal Aboriginal Corporation holds land in trust for the Pilki people of Western Australia’s Central Desert region. Their native title rights and interests were first recognised in the Pilki People determination of 2014. The determination area covers approximately 24,398 square kilometres, bordered by Neale Junction Nature Reserve, the Ngaanyatjarra Native Title Determination Area, and the Spinifex Native Title Determination Area.

Although the State did not dispute the Pilki people’s exclusive native title over the determination area as agreed in Willis on behalf of the Pilki People v State of Western Australia [2014] FCA 714, it did dispute the decision by North J that the native title rights and interests of the Pilki people over the determination area included the taking of resources for any purpose, including commercial.

The State’s appeal was dismissed, and in Willis on behalf of the Pilki People v State of Western Australia (No 2) [2014] FCA 1293 McKerracher J decided that the native title determination was to take effect immediately on the nomination of a Prescribed Body Corporate by the Pilki people. Kaltupakal Aboriginal Corporation was registered with ORIC on 6 April 2016, and nominated as trustee of the claim area on 5 May 2016.
